Unfortunately, practices and policies in the area of Fair Use are so confusing that libraries vary greatly in their actions based upon their fear of potential lawsuits. Some libraries hide questionable activities behind firewalls, while other libraries unnecessarily re-purchase materials without exploring legitimate rights. Publishers and libraries need to come together in a public forum to develop best practices that provide mutually beneficial solutions; respecting the intention of protecting trade publication authors without disadvantaging scholarly authors.
