(SCOPE).<\/strong> This Act is intended to recognize the rights of Mother Earth, and the obligations and duties of the Multinational State and society to ensure respect for these rights.<\/p>\n<p><strong>Article 2. (PRINCIPLES).<\/strong> The binding principles that govern this law are:<\/p>\n<p style=\"padding-left: 30px\">1. <strong>Harmony.<\/strong> Human activities, within the framework of plurality and diversity, should achieve a dynamic balance with the cycles and processes inherent in Mother Earth.<\/p>\n<p style=\"padding-left: 30px\">2. <strong>Collective good.<\/strong> The interests of society, within the framework of the rights of Mother Earth, prevail in all human activities and any acquired right.<\/p>\n<p style=\"padding-left: 30px\">3. <strong>Guarantee of the regeneration of Mother Earth.<\/strong> The state, at its various levels, and society, in harmony with the\u00a0common\u00a0interest, must ensure the necessary conditions in order that the diverse living systems of Mother Earth may absorb damage, adapt\u00a0to shocks, and regenerate without significantly altering their structural and functional characteristics, recognizing that living\u00a0systems are limited in their ability to regenerate, and that humans are limited in their ability to undo their actions.<\/p>\n<p style=\"padding-left: 30px\">4. <strong>Respect and defend the rights of Mother Earth.<\/strong> The State and any individual or collective person must respect, protect and\u00a0guarantee the rights of Mother Earth for the well-being of current and future generations.<\/p>\n<div id=\"attachment_3964\" style=\"width: 530px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/library.brown.edu\/create\/modernlatinamerica\/wp-content\/uploads\/sites\/42\/2013\/07\/110412motherearth.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-3964\" class=\"size-full wp-image-3964\" alt=\"110412motherearth\" src=\"https:\/\/library.brown.edu\/create\/modernlatinamerica\/wp-content\/uploads\/sites\/42\/2013\/07\/110412motherearth.jpg\" width=\"520\" height=\"343\" srcset=\"https:\/\/library.brown.edu\/create\/modernlatinamerica\/wp-content\/uploads\/sites\/42\/2013\/07\/110412motherearth.jpg 520w, https:\/\/library.brown.edu\/create\/modernlatinamerica\/wp-content\/uploads\/sites\/42\/2013\/07\/110412motherearth-300x198.jpg 300w, https:\/\/library.brown.edu\/create\/modernlatinamerica\/wp-content\/uploads\/sites\/42\/2013\/07\/110412motherearth-455x300.jpg 455w\" sizes=\"auto, (max-width: 520px) 100vw, 520px\" \/><\/a><p id=\"caption-attachment-3964\" class=\"wp-caption-text\">John Vidal&#8217;s photograph (10 April 2011, The Guardian UK) of Guatemalan demonstration for the rights of Mother Earth<\/p><\/div>\n<p style=\"padding-left: 30px\">5. <strong>No commercialism.<\/strong> Neither living systems nor processes that sustain them may be commercialized, nor serve anyone&#8217;s private\u00a0property.<\/p>\n<p style=\"padding-left: 30px\">6. <strong>Multiculturalism.<\/strong> The exercise of the rights of Mother Earth requires the recognition, recovery, respect, protection, and\u00a0dialogue of the diversity of feelings, values, knowledge, skills, practices, skills, transcendence, transformation, science,\u00a0technology and standards, of all the cultures of the world who seek to live in harmony with nature.<\/p>\n<p><strong>CHAPTER II<\/strong><br \/>\n<strong>MOTHER EARTH, DEFINITION AND CHARACTER<\/strong><\/p>\n<p><strong>Article 3. (Mother Earth).<\/strong> Mother Earth is a dynamic living system comprising an indivisible community of all living systems\u00a0and living organisms, interrelated, interdependent and complementary, which share a common destiny.<\/p>\n<p>Mother Earth is considered sacred, from the worldviews of nations and peasant indigenous peoples.<\/p>\n<p><strong>Article 4. (LIVING SYSTEMS).<\/strong> Living systems are complex and dynamic communities of plants, animals, microorganisms\u00a0and other beings and their environment, where human communities and the rest of nature interact as a functional unit under the\u00a0influence of climatic, physiographic, and geological factors, as well as production practices, Bolivian cultural diversity, and the\u00a0worldviews of nations, original indigenous peoples, and intercultural and Afro-Bolivian communities.<\/p>\n<p><strong>Article 5. (LEGAL STATUS OF MOTHER EARTH).<\/strong> For the purpose of protecting and enforcing its rights, Mother Earth\u00a0takes on the character of collective public interest. Mother Earth and all its components, including human communities, are\u00a0entitled to all the inherent rights recognized in\u00a0this Law. The exercise of the rights of Mother Earth will take into account the specificities and particularities of its various\u00a0components. The rights under this Act shall not limit the existence of other rights of Mother Earth.<\/p>\n<p><strong>Article 6. (EXERCISE OF THE RIGHTS OF THE MOTHER EARTH).<\/strong> All Bolivians, to join the community of beings\u00a0comprising Mother Earth, exercise rights under this Act, in a way that is consistent with their individual and collective rights.<\/p>\n<p>The exercise of individual rights is limited by the exercise of collective rights in the living systems of Mother Earth. Any conflict\u00a0of rights must be resolved in ways that do not irreversibly affect the functionality of living systems.<\/p>\n<p><strong>CHAPTER III<\/strong><br \/>\n<strong>RIGHTS OF MOTHER EARTH<\/strong><\/p>\n<p><strong>Article 7. (RIGHTS OF MOTHER EARTH)\u00a0I.<\/strong> Mother Earth has the following rights:<\/p>\n<p style=\"padding-left: 30px\">1. <strong>Right to life:<\/strong> The right to maintain the integrity of living systems and natural processes that sustain them, and capacities and\u00a0conditions for regeneration.<\/p>\n<p style=\"padding-left: 30px\">2. <strong>Right to the diversity of life<\/strong>: It is the right to preservation of differentiation and variety of beings that make up Mother Earth,\u00a0without being genetically altered or structurally modified in an artificial way, so that their existence, functioning or future potential\u00a0would be threatened.<\/p>\n<p style=\"padding-left: 30px\">3. <strong>Right to water:<\/strong> The right to preserve the functionality of the water cycle, its existence in the quantity and quality needed to sustain\u00a0living systems, and its protection from pollution for the reproduction of the life of Mother Earth and all its components.<\/p>\n<p style=\"padding-left: 30px\">4. <strong>Right to clean air:<\/strong> The right to preserve the quality and composition of air for sustaining living systems and its protection from\u00a0pollution, for the reproduction of the life of Mother Earth and all its components.<\/p>\n<p style=\"padding-left: 30px\">5. <strong>Right to equilibrium:<\/strong> The right to maintenance or restoration of the interrelationship, interdependence, complementarity and\u00a0functionality of the components of Mother Earth in a balanced way for the continuation of their cycles and reproduction of their\u00a0vital processes.<\/p>\n<p style=\"padding-left: 30px\">6. <strong>Right to restoration:<\/strong> The right to timely and effective restoration of living systems affected by human activities directly or\u00a0indirectly.<\/p>\n<p style=\"padding-left: 30px\">7. <strong>Right to pollution-free living:<\/strong> The right to the preservation of any of Mother Earth&#8217;s components from contamination, as well as\u00a0toxic and radioactive waste generated by human activities.<\/p>\n<p><strong>CHAPTER IV<\/strong><br \/>\n<strong>STATE OBLIGATIONS AND SOCIETAL DUTIES<\/strong><\/p>\n<p><strong>Article 8. (OBLIGATIONS OF THE PLURINATIONAL STATE).<\/strong> The Plurinational State, at all levels and geographical\u00a0areas and across all authorities and institutions, has the following duties:<\/p>\n<p style=\"padding-left: 30px\">1. Develop public policies and systematic actions of prevention, early warning, protection, and precaution in order to prevent\u00a0human activities causing the extinction of living populations, the alteration of the cycles and processes that ensure life, or the\u00a0destruction of livelihoods, including cultural systems that are part of Mother Earth.<\/p>\n<p style=\"padding-left: 30px\">2. Develop balanced forms of production and patterns of consumption to satisfy the needs of the Bolivian people to live well,\u00a0while safeguarding the regenerative capacity and integrity of the cycles, processes and vital balance of Mother Earth.<\/p>\n<p style=\"padding-left: 30px\">3. Develop policies to protect Mother Earth from the multinational and international scope of the exploitation of its components,\u00a0from the commodification of living systems or the processes that support them, and from the structural causes and effects of\u00a0global climate change.<\/p>\n<p style=\"padding-left: 30px\">4. Develop policies to ensure long-term energy sovereignty, increased efficiency and the gradual incorporation of clean and\u00a0renewable alternative sources into the energy matrix.<\/p>\n<p style=\"padding-left: 30px\">5. Demand international recognition of environmental debt through the financing and transfer of clean technologies that are\u00a0effective and compatible with the rights of Mother Earth, among other mechanisms.<\/p>\n<p style=\"padding-left: 30px\">6. Promote peace and the elimination of all nuclear, chemical, and biological arms and weapons of mass destruction.<\/p>\n<p style=\"padding-left: 30px\">7. Promote the growth and recognition of rights of Mother Earth in multilateral, regional and bilateral international relations.<\/p>\n<p><strong>Article 9. (DUTIES OF THE PEOPLE).<\/strong> The duties of natural persons and public or private legal entities:<\/p>\n<p style=\"padding-left: 30px\">1. Uphold and respect the rights of Mother Earth.<\/p>\n<p style=\"padding-left: 30px\">2. Promote harmony with Mother Earth in all areas of its relationship with other human communities and the rest of nature in\u00a0living systems.<\/p>\n<p style=\"padding-left: 30px\">3. Participate actively, individually or collectively, in generating proposals designed to respect and defend the rights of Mother\u00a0Earth.<\/p>\n<p style=\"padding-left: 30px\">4. Assume production practices and consumer behavior in harmony with the rights of Mother Earth.<\/p>\n<p style=\"padding-left: 30px\">5. Ensure the sustainable use of Mother Earth&#8217;s components.<\/p>\n<p style=\"padding-left: 30px\">6. Report any act that violates the rights of Mother Earth, living systems, and\/or their components.<\/p>\n<p style=\"padding-left: 30px\">7. Attend the convention of competent authorities or organized civil society to implement measures aimed at preserving and\/or\u00a0protecting Mother Earth.<\/p>\n<p><strong>Article 10. (DEFENSE OF MOTHER EARTH).<\/strong> Establishing the Office of Mother Earth, whose mission is to ensure the\u00a0validity, promotion, distribution and compliance of the rights of Mother Earth established in this Act. A special law will establish\u00a0its structure, function, and attributes.<\/p>\n<p>Refer to the Executive Branch for constitutional ends.<\/p>\n<p>It is given in the Assembly Hall of the Plurinational Legislative Assembly, on the seventh day of the month of December two\u00a0thousand and ten.<\/p>\n<p>Sen. H\u00e9ctor Enrique Arce Zaconeta<\/p>\n<p>PRESIDENT<\/p>\n<p>CHAMBER OF DEPUTIES<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"text-decoration: underline\">Original Spanish:<\/span><\/p>\n<h2>Ley Corta de Derechos de la Madre Tierra<\/h2>\n<p align=\"center\"><strong>T\u00cdTULO I<\/strong><\/p>\n<div>\n<p align=\"center\"><strong>DISPOSICIONES GENERALES<br \/>\n<\/strong><strong>CAP\u00cdTULO I<br \/>\n<\/strong><strong>OBJETO Y PRINCIPIOS<\/strong><\/p>\n<p><strong>Art\u00edculo 1. (OBJETO).\u00a0<\/strong>La presente Ley tiene por objeto reconocer los derechos de la Madre Tierra, as\u00ed como las obligaciones y deberes del Estado Plurinacional y de la sociedad para garantizar el respeto de estos derechos.<\/p>\n<p><strong>Art\u00edculo 2. (PRINCIPIOS).\u00a0<\/strong>Los principios, de obligatorio cumplimiento, que rigen la presente ley son:<\/p>\n<ol>\n<li><strong>Armon\u00eda.<\/strong>\u00a0Las actividades humanas, en el marco de la pluralidad y la diversidad, deben lograr equilibrios din\u00e1micos con los ciclos y procesos inherentes a la Madre Tierra.<\/li>\n<li><strong>Bien Colectivo.\u00a0<\/strong>El inter\u00e9s de la sociedad, en el marco de los derechos de la Madre Tierra, prevalecen en toda actividad humana, y por sobre cualquier derecho adquirido.<\/li>\n<li><strong>Garant\u00eda de regeneraci\u00f3n de la Madre Tierra.\u00a0<\/strong>El Estado en sus diferentes niveles y la sociedad, en armon\u00eda con el inter\u00e9s com\u00fan, deben garantizar las condiciones necesarias para que los diversos sistemas de vida de la Madre Tierra puedan absorber da\u00f1os, adaptarse a las perturbaciones, y regenerarse, sin alterar significativamente sus caracter\u00edsticas de estructura y funcionalidad, reconociendo que los sistemas de vida tienen l\u00edmites en su capacidad de regenerarse, y que la humanidad tienen l\u00edmites en su capacidad de revertir sus acciones.<\/li>\n<li><strong>Respeto y defensa de los Derechos de la Madre Tierra.\u00a0<\/strong>El Estado y cualquier persona individual o colectiva respetan, protegen y garantizan los derechos de la Madre Tierra para el Vivir Bien de las generaciones actuales y las futuras.<\/li>\n<li><strong>No mercantilizaci\u00f3n.<\/strong>\u00a0Por el que no pueden ser mercantilizados los sistemas de vida, ni los procesos que sustentan, ni formar parte del patrimonio privado de nadie.<\/li>\n<li><strong>Interculturalidad.\u00a0<\/strong>El ejercicio de los derechos de la Madre Tierra requiere del reconocimiento, recuperaci\u00f3n, respeto, protecci\u00f3n, y di\u00e1logo de la diversidad de sentires, valores, saberes, conocimientos, pr\u00e1cticas, habilidades, trascendencias, transformaciones, ciencias, tecnolog\u00edas y normas, de todas las culturas\u00a0del mundo\u00a0que buscan\u00a0convivir\u00a0en armon\u00eda con la naturaleza<\/li>\n<\/ol>\n<p align=\"center\"><strong>T\u00cdTULO II<br \/>\n<\/strong><strong>MADRE TIERRA<br \/>\n<\/strong><strong>CAP\u00cdTULO I<br \/>\n<\/strong><strong>DEFINICI\u00d3N Y CAR\u00c1CTER<\/strong><\/p>\n<p><strong>Art\u00edculo 3. (MADRE TIERRA).\u00a0\u00a0<\/strong>La Madre Tierra es el sistema viviente din\u00e1mico conformado por la comunidad indivisible de todos los sistemas de vida y los seres vivos, interrelacionados, interdependientes y complementarios, que comparten un destino com\u00fan.<\/p>\n<p>La Madre Tierra es considerada sagrada, desde las cosmovisiones de las naciones y pueblos ind\u00edgena originario campesinos.<\/p>\n<p><strong>Art\u00edculo 4. (SISTEMAS DE VIDA).\u00a0<\/strong>Son\u00a0comunidades complejas y din\u00e1micas de plantas, animales, micro organismos y otros seres y su entorno, donde interact\u00faan comunidades humanas y el resto de la naturaleza como una unidad funcional, bajo la influencia de factores clim\u00e1ticos, fisiogr\u00e1ficos y geol\u00f3gicos, as\u00ed como de las pr\u00e1cticas productivas, y la diversidad cultural de las bolivianas y los bolivianos, y las cosmovisiones las naciones y pueblos ind\u00edgena originarios campesinos, las comunidades interculturales y afrobolivianas.<\/p>\n<p><strong>Art\u00edculo 5. (CAR\u00c1CTER JUR\u00cdDICO DE LA MADRE TIERRA).\u00a0<\/strong>Para efectos de la protecci\u00f3n y tutela de sus derechos, la Madre Tierra adopta el car\u00e1cter de sujeto colectivo de inter\u00e9s p\u00fablico.\u00a0La Madre Tierra y todos sus componentes incluyendo las comunidades humanas son titulares de todos los derechos inherentes reconocidos en esta Ley. La aplicaci\u00f3n de los derechos de la Madre Tierra tomar\u00e1 en cuenta las especificidades y particularidades de sus diversos componentes. Los derechos establecidos en la presente Ley, no limitan la existencia de otros derechos de la Madre Tierra.<\/p>\n<p><strong>Art\u00edculo 6. (EJERCICIO DE LOS DERECHOS DE LA MADRE TIERRA).<\/strong>\u00a0Todas las bolivianas y bolivianos, al formar parte de la comunidad de seres que componen la Madre Tierra, ejercen los derechos establecidos en la presente Ley, de forma compatible con sus derechos individuales y colectivos.<\/p>\n<p>El ejercicio de los derechos individuales est\u00e1n limitados por el ejercicio de los derechos colectivos en los sistemas de vida de la Madre Tierra, cualquier conflicto entre derechos debe resolverse de manera que no se afecte irreversiblemente la funcionalidad de los sistemas de vida.<\/p>\n<p align=\"center\"><strong>CAP\u00cdTULO II<br \/>\n<\/strong><strong>DERECHOS DE LA MADRE TIERRA<\/strong><\/p>\n<p><strong>Art\u00edculo 7. (DERECHOS DE LA MADRE TIERRA) I.\u00a0<\/strong>La Madre Tierra tiene los siguientes derechos:<\/p>\n<p style=\"padding-left: 30px\">1.\u00a0<strong>Derecho a la vida<\/strong>: Es el mantenimiento de la integridad de los sistemas de vida, y los procesos naturales que los sustentan, as\u00ed como las capacidades y condiciones para su regeneraci\u00f3n.<\/p>\n<p style=\"padding-left: 30px\">2.\u00a0<strong>Derecho a la diversidad de la vida:\u00a0<\/strong>Es la preservaci\u00f3n de la diferenciaci\u00f3n\u00a0\u00a0y la variedad de los seres que componen la Madre Tierra, sin ser alterados gen\u00e9ticamente ni modificados en su estructura de manera artificial, de tal forma que se amenace su existencia, funcionamiento y potencial futuro.<\/p>\n<p style=\"padding-left: 30px\">3.\u00a0<strong>Derecho al agua<\/strong>: Es la preservaci\u00f3n de la funcionalidad de los ciclos del agua, de su existencia en la cantidad y calidad necesarias para el sostenimiento de los sistemas de vida, y su protecci\u00f3n frente a la contaminaci\u00f3n, para la reproducci\u00f3n de la vida de la Madre Tierra y todos sus componentes.<\/p>\n<p style=\"padding-left: 30px\">4.\u00a0<strong>Derecho al aire limpio<\/strong>: Es la preservaci\u00f3n de la calidad y composici\u00f3n del aire para el sostenimiento de los sistemas de vida y su protecci\u00f3n frente a la contaminaci\u00f3n, para la reproducci\u00f3n de la vida de la Madre Tierra y todos sus componentes.<\/p>\n<p style=\"padding-left: 30px\">5.\u00a0<strong>Derecho al equilibro:\u00a0<\/strong>Es el mantenimiento o restauraci\u00f3n de la interrelaci\u00f3n, interdependencia, complementariedad y funcionalidad de los componentes de la Madre Tierra, de forma equilibrada para la continuaci\u00f3n de sus ciclos y la reproducci\u00f3n de sus procesos vitales.<\/p>\n<p style=\"padding-left: 30px\">6.\u00a0<strong>Derecho a la restauraci\u00f3n<\/strong>: Es la restauraci\u00f3n oportuna y efectiva de los sistemas de vida afectados por las actividades humanas directa o indirectamente.<\/p>\n<p style=\"padding-left: 30px\">7.<strong> Derecho a vivir libre de contaminaci\u00f3n<\/strong>: Es la preservaci\u00f3n de la Madre Tierra de contaminaci\u00f3n de cualquiera de sus componentes, as\u00ed como de residuos t\u00f3xicos y radioactivos generados por las actividades humanas.<\/p>\n<p align=\"center\"><strong>CAP\u00cdTULO III<br \/>\n<\/strong><strong>OBLIGACIONES DEL ESTADO Y DEBERES DE LA SOCIEDAD<\/strong><\/p>\n<p><strong>Art\u00edculo<\/strong><strong>\u00a0<\/strong><strong>8.\u00a0\u00a0(OBLIGACIONES DEL ESTADO PLURINACIONAL).\u00a0<\/strong>El Estado Plurinacional,<strong>\u00a0<\/strong>en todos sus niveles y \u00e1mbitos territoriales, y a trav\u00e9s de todas sus autoridades e instituciones, tiene las siguientes obligaciones:<\/p>\n<p>1.\u00a0\u00a0Desarrollar pol\u00edticas p\u00fablicas, y acciones sistem\u00e1ticas de prevenci\u00f3n, alerta temprana, protecci\u00f3n, precauci\u00f3n, para evitar que las actividades humanas conduzcan a la extinci\u00f3n de poblaciones de seres, la alteraci\u00f3n de los ciclos y procesos que garantizan la vida, o la destrucci\u00f3n de sistemas de vida, que incluyen los sistemas culturales que son parte de la Madre Tierra.<\/p>\n<p>2. \u00a0Desarrollar formas de producci\u00f3n y patrones de\u00a0consumo equilibrados para\u00a0la satisfacci\u00f3n de las necesidades del pueblo boliviano para el Vivir Bien,\u00a0salvaguardando las capacidades regenerativas, y la integridad de los ciclos, procesos y equilibrios vitales\u00a0de la Madre Tierra.<br \/>\n3.\u00a0\u00a0Desarrollar pol\u00edticas para defender la Madre Tierra en el \u00e1mbito plurinacional e internacional de la sobreexplotaci\u00f3n de sus componentes, de la mercantilizaci\u00f3n de los sistemas de vida o los procesos que los sustentan, y de las causas estructurales del Cambio Clim\u00e1tico Global y sus efectos.<\/p>\n<p>4. \u00a0Desarrollar pol\u00edticas para asegurar la soberan\u00eda energ\u00e9tica a largo plazo, a partir del ahorro, el aumento de la eficiencia y la incorporaci\u00f3n paulatina de fuentes alternativas limpias y renovables en la matriz energ\u00e9tica.<\/p>\n<p>5. \u00a0Demandar en el \u00e1mbito internacional el reconocimiento de la deuda ambiental a trav\u00e9s de financiamiento y transferencia de tecnolog\u00edas limpias, efectivas y compatibles con los derechos de la Madre Tierra, adem\u00e1s de otros mecanismos.<\/p>\n<p>6. \u00a0Promover la paz y la eliminaci\u00f3n de todas las armas nucleares, qu\u00edmicas, biol\u00f3gicas y de destrucci\u00f3n masiva.<\/p>\n<p>7. \u00a0Promover el reconocimiento y defensa de los derechos de la Madre Tierra en el \u00e1mbito multilateral, regional y bilateral de las relaciones internacionales.<\/p>\n<p><strong>Art\u00edculo 9.\u00a0\u00a0(DEBERES DE LAS PERSONAS)\u00a0<\/strong>Son deberes de las personas naturales y jur\u00eddicas, p\u00fablicas o resto de las comunidades humanas y el resto de la naturaleza en los sistemas de vida.<\/p>\n<p>3.\u00a0Participar de forma activa, personal o colectivamente, en la generaci\u00f3n de propuestas orientadas al respeto y la defensa de los derechos de la Madre Tierra.<\/p>\n<p>4.\u00a0Asumir pr\u00e1cticas de producci\u00f3n y h\u00e1bitos de consumo, en armon\u00eda con los derechos de la Madre Tierra.<\/p>\n<p>5.\u00a0Asegurar el uso y aprovechamiento sustentable de los componentes de la Madre Tierra.<\/p>\n<p>6.\u00a0Denunciar todo acto que atente contra los derechos de la Madre Tierra, sus sistemas de vida y\/o sus componentes.<\/p>\n<p>7.\u00a0Acudir a la convocatoria de las autoridades competentes o la sociedad civil organizada para la realizaci\u00f3n de acciones orientadas a la conservaci\u00f3n y\/o protecci\u00f3n de la Madre Tierra.<\/p>\n<p><strong>Art\u00edculo 10. (DEFENSOR\u00cdA DE LA MADRE TIERRA)<\/strong>. Se crea la Defensor\u00eda de la Madre Tierra, cuya misi\u00f3n es velar por la vigencia, promoci\u00f3n, difusi\u00f3n y cumplimiento de los derechos de la Madre Tierra, establecidos en la presente Ley.
